Omniyal AI Service Agreement & PDPA Compliance

1. Terms and Conditions Agreement

  • Usage Terms: The AI chatbot service optimizes business operations. Terms may be updated, and continued use implies acceptance. Pricing may change.
  • Service Period: Subscriptions renew automatically unless canceled according to the outlined procedure.
  • Client Responsibilities: Clients must provide accurate data and comply with laws. Lack of collaboration may delay service.
  • Pricing and Taxes: A 6% service tax applies under Malaysian tax laws, and pricing may change.

2. Privacy Policy Consent

  • PDPA Compliance: We comply with Malaysia’s PDPA 2010.
  • Data Collection: Personal data includes company insights and customer interaction data.
  • Data Usage: Data is used for service improvement, analytics, and customer engagement.
  • Data Sharing: We may share data with third parties under confidentiality agreements.
  • Data Retention: Data is retained for one month after cancellation and then securely deleted.
  • Client Consent: By signing up, clients give explicit consent to data collection, use, and sharing.

3. Confidentiality Agreement

  • Confidentiality Clause: All data and company insights remain confidential and are accessible to authorized personnel only.
  • Non-Disclosure Agreement (NDA): No disclosure of client information outside the agreed scope of the service.
  • Security Measures: Data is protected through encryption, secure access controls, and monitoring.

4. Data Processing Agreement (DPA)

  • PDPA Adherence: Our DPA ensures compliance with PDPA for personal data processing.
  • Data Subject Rights: Clients can request access, correction, or withdrawal of their data.
  • Third-Party Processors: We disclose third-party processors but keep their identity confidential as per our agreements.

5. Consent to Use Feedback

  • Feedback Usage: Client feedback may be used for product improvement, marketing, or testimonials.
  • Anonymity Option: Clients may choose to provide feedback anonymously.

6. Limitation of Liability

  • Liability Clause: Our liability is limited to direct damages, up to six months of service fees.
  • Indemnity: Clients indemnify Omniyal AI from any claims arising from improper use of the AI chatbot service.

7. Opt-Out and Termination

  • Withdrawal Rights: Clients may withdraw their data and cancel their service at any time.
  • Termination Clause: Either party may terminate the agreement, with data deleted one month after termination.

8. Acknowledgment and Acceptance

  • Consent Checkbox: Clients acknowledge agreement to the terms through an online checkbox.
  • No Signature Required: Consent is captured electronically.

9. No Refund Policy

  • No Refunds: No refunds will be provided after signing up. Clients may cancel subscriptions for future billing periods.

10. Subscription Termination & Data Deletion

  • Data Retention After Cancellation: Once canceled, data will be retained for one month before permanent deletion.

11. Backup & Recovery

  • Backup Policy: We maintain backups of client data for continuity, which are also deleted after one month following subscription cancellation.

12. Service Disruption Disclaimer

  • No Responsibility for External Disruptions: We are not liable for any service disruptions caused by external factors, such as technical failures or force majeure events.

13. Modification of Terms

  • Changes to Terms: We reserve the right to update these terms, and continued use of the service indicates acceptance of any changes.
